One of the interesting points in the Fairness Doctrine debate is that because the Federal Government owns and licenses the broadcast frequencies that they can require licensees to only broadcast approved content. This is an interesting legal point.

This is a critical component of Freedom of Speech that needs to be better understood. Obviously, the satellite broadcasters and the Mexican Radio channels do what they can to broadcast their content from beyond the governance and control of the FCC.

However, the debatable question is who actually owns the frequencies that broadcaster's license?
